Terms And Conditions
1. Introduction Welcome to Vision Homes, a construction company located at A302 Polo Offices, Val de Vie, Paarl 7647, South Africa. These terms and conditions govern the relationship between Vision Homes ("we", "our", "us") and our clients ("you", "your"). By engaging our services, you agree to these terms, which comply with South African law, including the Consumer Protection Act, National Building Regulations, and the Protection of Personal Information Act (POPIA).

2. Compliance with South African Law Vision Homes operates in compliance with South African laws, including:

Consumer Protection Act (CPA) 2008: Ensuring fair value, safe services, and transparency in all engagements.

National Building Regulations and Building Standards Act: Adherence to all relevant construction standards.

Occupational Health and Safety Act (OHSA): Ensuring health and safety on all project sites.

Electronic Communications and Transactions Act (ECTA): Governing any digital or electronic transactions or communications.

South African Contract Law: Ensuring the enforceability of contracts, including agreements on payments, work scope, and project deliverables.

3. Scope of Services Vision Homes provides a range of construction services, including building, renovations, and maintenance. The services will be provided in accordance with the agreed scope outlined in individual project contracts. Certain exclusions or limitations may apply based on geographical restrictions or project-specific circumstances.

4. Quotations and Estimates

Quotations are provided based on the information available at the time of the request and are valid for 30 days.

We reserve the right to adjust quotes if unforeseen circumstances arise (e.g., site conditions, weather disruptions, or material shortages).

Any changes to the project scope requested after work has commenced will result in a revised quotation.

5. Pricing and Payment Terms

All pricing is calculated based on a combination of fixed rates and materials.

A deposit of 30% is required prior to commencement of work, with instalments payable at key project milestones.

Final payment is due within 7 days of project completion.

Late payments will incur an interest rate of 2% per month, and Vision Homes reserves the right to halt work until overdue payments are made.

6. Dispute Resolution

Any disputes will first be addressed through internal discussions. If unresolved, the dispute will be referred to mediation or arbitration.

The parties agree that any legal action will be governed by South African law and resolved within the jurisdiction of the courts in Paarl, South Africa.

7. Liability and Insurance

Vision Homes will not be held liable for any delays or additional costs arising from circumstances beyond our control (e.g., extreme weather, supply chain issues).

We maintain comprehensive public liability insurance. Clients are responsible for ensuring their own property is adequately insured during construction.

8. Warranties and Guarantees

Vision Homes provides a 12-month warranty on workmanship from the date of project completion. Any defects arising from our services will be repaired at no additional cost, provided that they are reported within the warranty period.

The warranty does not cover defects resulting from external factors or misuse.

9. Termination and Cancellation

Either party may terminate the contract if the other party fails to fulfil its obligations, such as failure to make payments or breach of safety protocols.

In the event of cancellation after significant work has commenced, Vision Homes reserves the right to charge for completed work and materials.

10. Health and Safety

Vision Homes complies with the OHSA. Our team follows strict safety protocols on all sites.

Clients must provide a safe environment, and any safety risks identified must be addressed before work can continue.

11. Intellectual Property

All designs, plans, and other intellectual property created by Vision Homes remain the property of Vision Homes unless otherwise agreed upon in writing.

12. Confidentiality

Any confidential information shared between the parties shall remain confidential and not disclosed to third parties without written consent.

13. Privacy and Data Protection

Vision Homes is committed to protecting personal data in compliance with POPIA. Any personal information collected will only be used for the purposes of project management and communication.

14. Force Majeure

Vision Homes is not liable for delays or failure to complete projects due to circumstances beyond our control, such as natural disasters, strikes, or pandemics.

15. Amendments and Updates

We reserve the right to amend these terms and conditions as needed to reflect changes in business practices or legal requirements. Clients will be notified of any updates.

16. Jurisdiction

These terms and conditions are governed by the laws of South Africa, and any disputes will be subject to the jurisdiction of the courts in Paarl, South Africa.
